[5] Pendleton [8] “Although the 1907 Act has been repeatedly amended, the scheme of the Act has not been fundamentally altered. The most notable change has been the granting by the Criminal Appeal Act 1964 and the extension by the Criminal Justice Act 1988 of a power, on the allowing of an appeal against conviction, to order a retrial.”

[6] In R v Ward [1993] 2 All ER 577 it was said that the courts must be vigilant to ensure that it can identify confessions which may be untrue.

[7] In R v Kelly and Connolly [2002] EWCA Crim 2957 it was said that if it wasn’t for Graham’s [untrue] evidence, Kelly would not have been convicted [and hanged]. The Under Secretary had confirmed the Secretary of State’s decision to recommend the remission of the remainder of Graham’s sentence and his immediate release from custody following upon his “assistance” in this matter.

[8] In Kelly and Connolly, Graham had said that he had also heard a confession from Johnson to having committed the crime.
