I, Professor Malcolm McDougal Fisher make oath [or affirm] and say as follows:

I am a registered medical practitioner, and Professor of the Intensive Therapy Unit at the RoyalNorth Shore Hospital in Sydney.

I am Clinical Professor in Intensive Care Medicine at the Departments of Medicine and Anaesthesia at the University of Sydney.

I am Visiting Medical Officer at the North Shore Private Hospital at the Sydney Adventist Hospital.

I am Area Director for Intensive Care for Northern Sydney Area Health.

Now produced and shown to me and marked MMF1 is a copy of my curriculum vitae of ** pages.

I have been provided with the draft affidavits of Professor Tony Thomas and Dr Byron Collins which I have perused.

I have also perused the information contained in what has been described as the “Anaphylaxis Report”. I have no disagreement with any of the information contained in that report.

Now produced and shown to me and marked MMF2 is a copy of the said report.

I have seen the list of materials referred to by Dr Peter Scally and to those contained in my curriculum vitae.

In my opinion anaphylaxis should have been considered as a potential cause of death in the case of the death of Ms Anna-Jane Cheney. In particular, a full post mortem examination should have been conducted, including measurement of mast cell tryptase levels from post mortem blood.
